Use of the ekory product is governed by a separate Master Services Agreement. ## 1. Acceptance By accessing or using the ekory.ai website (the "Site") you agree to these Terms of Use. If you do not agree, please do not use the Site. ## 2. What these terms cover These Terms govern your use of this **website**, and section 10 describes the emails we may send you if you sign up to ekory. Your use of the ekory product and services is governed by a separate written agreement (the "Master Services Agreement") and our [Data Processing Agreement](https://ekory.ai/dpa); in case of conflict, those agreements prevail for the service. ## 3. Permitted use You may use the Site for lawful, informational purposes. You agree not to: - use the Site in any way that breaches applicable law or these Terms; - attempt to gain unauthorised access to, disrupt, or overload the Site or its infrastructure; - scrape, harvest, or systematically extract content except as permitted by our [robots.txt](https://ekory.ai/robots.txt); - misrepresent your identity or affiliation. ## 4. Intellectual property All content on the Site (text, graphics, layout, and code) is owned by or licensed to ekory S.r.l. and is protected by intellectual property laws. You may view and share links to the Site, but you may not reproduce, modify, or distribute its content without our prior written permission. The Geist typefaces are used under the SIL Open Font License. ## 5. Trademarks "ekory", the ekory logo, and related marks are trademarks of ekory S.r.l. You may not use them without our prior written consent. ## 6. Third-party links & services The Site links to third-party services such as our scheduling provider (Calendly) and our application at app.ekory.ai. We are not responsible for the content or practices of third-party services, which are governed by their own terms. ## 7. No warranties The Site is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties as to its availability, accuracy, or fitness for a particular purpose. Content is provided for general information and is not professional advice. ## 8. Limitation of liability To the maximum extent permitted by applicable law, ekory S.r.l. shall not be liable for any indirect or consequential loss arising from your use of, or inability to use, the Site. Nothing in these Terms excludes liability that cannot be excluded under mandatory law. ## 9. Privacy Our handling of personal data is described in the [Privacy Policy](https://ekory.ai/privacy) and [Cookie Policy](https://ekory.ai/cookies). ## 10. Email communications If you sign up to ekory directly, for example by creating a workspace through the self-service onboarding at app.ekory.ai, we may contact you by email at the address you signed up with: to help you set up your workspace, to follow up on your evaluation, and to tell you about ekory plans and services similar to the one you signed up for. You can stop these emails at any time, free of charge: reply to any of them asking us to stop, use the unsubscribe link where there is one, or write to [privacy@ekory.ai](mailto:privacy@ekory.ai). Messages essential to your account, such as sign-in links and security notices, are not affected. If you joined a workspace at the invitation of one of our customers, we do not send you these emails. Details are in section 4 of our [Privacy Policy](https://ekory.ai/privacy#emails). ## 11. Changes We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. ## 12. Governing law & jurisdiction These Terms are governed by the laws of Italy. The courts of Milan (Tribunale di Milano) shall have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence. ## 13.
